These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and ARchitect Vision, LLC ("Company," "we," "us," or "our") regarding your use of our website and services. 5. Payments and Subscriptions

A. Subscription Tiers

AR|chitect offers various subscription plans. By subscribing, you agree to pay the fees associated with your chosen plan.

B. Payment Terms

  • All payments are non-refundable unless otherwise specified.

  • Subscriptions automatically renew unless canceled prior to the renewal date.

C. Cancellation

You may cancel your subscription at any time through your account settings. Access to premium features will remain available until the end of your billing cycle.

6. Intellectual Property

All content, trademarks, and materials on the AR|chitect platform are owned by us or licensed to us. You may not use, reproduce, or distribute our intellectual property without our written consent.

7. Privacy

Your use of our services is subject to our Privacy Policy. By using our platform, you consent to our data collection, usage, and storage practices as outlined in the policy.

8. Limitation of Liability

To the fullest extent permitted by law, AR|chitect shall not be liable for:

  • Any indirect, incidental, or consequential damages arising from your use of the platform.

  • Errors or inaccuracies in our services.

  • Any unauthorized access to your account.

9. Termination

We reserve the right to terminate or suspend your account at our discretion, without notice, if we believe you have violated these Terms or engaged in harmful activities.

10. Third-Party Links

Our website may contain links to third-party websites. AR|chitect is not responsible for the content, privacy practices, or terms of these external sites. You use them at your own risk.

11. Dispute Resolution

Any disputes, claims, or controversies arising out of or relating to these Terms, the breach thereof, or your use of AR|chitect's services shall be resolved exclusively through binding arbitration. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration organization. The arbitration shall take place in Loudoun County, Virginia, or another location mutually agreed upon by both parties, and the proceedings shall be confidential. If an in-person hearing is not practical or preferred by either party, the arbitration may be conducted remotely via video conferencing or another agreed-upon method.

All arbitration proceedings, including but not limited to the content of the dispute, evidence presented, and the arbitration decision, shall remain strictly confidential. Neither party shall disclose any aspect of the proceedings to any third party, except as required by law, to enforce or challenge the arbitration decision, or with the written consent of both parties.

By agreeing to these Terms, you acknowledge and accept Loudoun County, Virginia, as the venue for arbitration and agree to maintain the confidentiality of the process.

Costs of Arbitration
Each party shall bear its own costs associated with arbitration, including attorney’s fees, unless the arbitrator determines that the claim was frivolous or filed in bad faith. AR|chitect will cover any arbitration filing fees or related administrative costs required to initiate the arbitration process.

Exceptions
This arbitration clause does not prevent you or AR|chitect from seeking injunctive relief in a court of competent jurisdiction to prevent the misuse of intellectual property, confidential information, or data breaches.

Enforceability
If any part of this arbitration agreement is found to be unenforceable or invalid under applicable law, the remaining parts shall still apply, and the unenforceable section shall be severed from the agreement.

By agreeing to these Terms, you explicitly waive the right to:

  • A trial by jury in any dispute, claim, or controversy arising from or related to these Terms or the use of our services.

  • Participation in any class action, collective action, or representative action against AR|chitect, either as a plaintiff or as a member of a class. All claims must be brought on an individual basis, and the arbitrator may not consolidate claims of multiple parties or preside over any form of a representative or class proceeding.

By using AR|chitect’s services, you acknowledge and agree to this dispute resolution process. If you do not agree, your sole remedy is to discontinue the use of our services.

12. Modifications to Terms

We may update these Terms from time to time. Changes will be effective immediately upon posting on our website. Your continued use of the platform constitutes acceptance of the updated Terms.
